These Rental Terms & Conditions (“Terms”) govern direct reservations made through the FABELLA Mountain Stay website for the vacation property located at 235-C Rue du Cercle des Cantons, Apartment 221, Bromont, Québec, Canada J2L 0R4 (“Property”).

FABELLA Mountain Stay is operated by FABELLA LLC (“FABELLA,” “we,” “us,” or “our”).

This website and its direct-booking services are intended for residents of Puerto Rico.

By completing a reservation, the person making the reservation (“Guest”) acknowledges that they have reviewed, understood, and agreed to these Terms, the Cancellation Policy, and the applicable Property Rules.

1. Reservation & Guest Responsibility

The person making the reservation must be at least 25 years old and must provide accurate identification, contact, guest-count, and payment information.

The person making the reservation is responsible for the reservation and for the conduct of all occupants and visitors associated with the reservation.

Only the number of guests identified in the reservation may occupy the Property overnight. Occupancy may not exceed the maximum capacity stated in the reservation or Property listing.

Reservations may not be transferred or resold without prior written authorization from FABELLA.

2. Reservation Confirmation & Payment

30% deposit of the total reservation amount is required to confirm the reservation.

The remaining 70% balance is due 24 hours before the scheduled check-in time.

A reservation is considered confirmed only after the required initial payment has been successfully processed and FABELLA has issued a reservation confirmation.

The total price, including the nightly rate, cleaning fee, applicable taxes and any other mandatory charges, will be disclosed before payment.

Payments are processed electronically through the payment processor available on the website.

3. Cancellation & Refund Policy

Guests may cancel 14 or more days before the scheduled check-in date and receive a refund of amounts paid.

Cancellations made less than 14 days before the scheduled check-in date are non-refundable, except when FABELLA determines that an Extraordinary Circumstance under Section 4 applies or when otherwise required by applicable law.

No refunds will ordinarily be issued for:

  • no-shows;
  • late arrivals;
  • early departures;
  • unused nights;
  • changes in personal plans; or
  • dissatisfaction with weather, snowfall or recreational conditions.

Approved refunds will be returned to the original payment method. Once FABELLA initiates a refund, the time required for the funds to appear in the Guest’s account is determined by the applicable payment processor, financial institution or card issuer.

4. Extraordinary Circumstances

FABELLA recognizes that rare and unforeseen circumstances outside a Guest’s reasonable control may make completion of a reservation impossible or legally prohibited.

Qualifying circumstances may include government-declared emergencies materially affecting the destination, government-imposed restrictions legally prohibiting travel to or occupancy of the Property, war or significant civil unrest, severe natural disasters, or major utility or infrastructure failures that make the Property inaccessible or unsuitable for occupancy.

Depending upon the circumstances, FABELLA may offer:

alternative available dates, a partial refund, or a full refund.

FABELLA may request reasonable documentation supporting the circumstances.

Personal illness or injury, work obligations, changes in personal plans, passport or immigration issues, cancellation of an event the Guest intended to attend, transportation disruptions, ordinary winter weather, road conditions, insufficient snowfall or changes in recreational conditions generally remain subject to the standard Cancellation Policy.

Nothing in this section limits rights that cannot legally be waived under applicable law.

5. Check-In & Check-Out

Official check-in and check-out times will appear on the reservation confirmation and/or arrival instructions.

Early check-in or late check-out requires prior approval from FABELLA and is subject to availability.

Guests must follow all instructions regarding building access, keys or electronic access devices, parking and departure procedures.

6. Property & Condominium Rules

Guests must respect the Property, condominium common areas, neighbors and all applicable condominium regulations.

Excessive noise, illegal activities, unauthorized events, conduct that materially disturbs other residents, or serious violations of condominium rules may result in termination of the stay, subject to applicable law.

Guests are responsible for ensuring that all persons in their party comply with these requirements.

Smoking: Not permitted inside the Property.

Parties or events: Not permitted without prior written authorization.

Pets: Only as expressly permitted in the reservation or with prior written authorization from FABELLA.

Specific quiet hours or additional condominium rules provided with the reservation or arrival instructions form part of the Property Rules.

7. Damage, Missing Items & Extraordinary Cleaning

Guests are responsible for damage to the Property, furniture, appliances, equipment or condominium common areas caused by the Guest or members of their party beyond ordinary wear and tear.

Guests must promptly report damage, malfunction, loss or safety concerns discovered during their stay.

FABELLA reserves the right, as permitted by applicable law and the applicable payment authorization, to seek reimbursement for documented damage, missing items or cleaning required beyond reasonable turnover cleaning.

8. Parking, Ski/Bike Storage & Common Amenities

Use of indoor parking, ski/bike storage, elevators, swimming pools and other building or resort amenities is subject to availability, seasonal operation, building regulations and applicable safety requirements.

Guests must use designated parking and storage areas and comply with instructions provided by FABELLA or the condominium administration.

Temporary closure or restricted availability of a common amenity outside FABELLA’s reasonable control does not automatically entitle a Guest to a refund.

9. Skiing, Mountain Biking & Other Recreational Activities

Bromont offers skiing, mountain biking, golf, hiking, water activities and other recreational experiences.

These activities are not operated or controlled by FABELLA unless expressly stated otherwise.

Guests participate in recreational activities voluntarily and are responsible for complying with the safety requirements, rules, waivers and conditions established by the respective activity providers.

FABELLA does not guarantee weather, snowfall, trail conditions, lift operations, opening dates or the availability of third-party recreational activities.

10. Third-Party Attractions & Services

References on the FABELLA website to restaurants, spas, ski areas, golf courses, wineries, attractions or other third-party businesses are provided to help Guests experience Bromont and the surrounding region.

Unless expressly stated otherwise, FABELLA does not own, operate or control these businesses and does not guarantee their prices, schedules, availability or services.

11. Property Unavailability

If circumstances outside FABELLA’s reasonable control make the Property unavailable or unsuitable for occupancy before the Guest’s arrival, FABELLA will make reasonable efforts to notify the Guest promptly.

If FABELLA cannot provide the reserved accommodation, the Guest will be offered, as appropriate, alternative available dates or a refund of amounts paid for the unavailable accommodation.

FABELLA will not be responsible for consequential or indirect expenses arising from circumstances outside its reasonable control, except to the extent otherwise required by applicable law.

12. Accuracy of Property Information

FABELLA makes reasonable efforts to accurately represent the Property, its furnishings, amenities and surrounding attractions.

Photographs are intended to provide a fair representation of the Property. Minor changes to furniture, décor, equipment or amenities that do not materially affect the Guest’s use of the Property will not ordinarily constitute grounds for cancellation.

13. Electronic Communications & Agreement

The Guest agrees that reservation confirmations, receipts, notices, Property Rules and other reservation-related documents may be provided electronically.

By checking the acceptance box during the reservation process and completing the booking, the Guest confirms acceptance of these Terms electronically.

Puerto Rico law recognizes electronic records, signatures and contracts and provides that legal effect may not be denied solely because they are electronic.

The Guest should retain a copy of the reservation confirmation and these Terms for their records.

14. Governing Law

The contractual relationship arising from a direct reservation made through this website shall, to the extent legally permissible, be governed by the laws of the Commonwealth of Puerto Rico.

Nothing in these Terms is intended to exclude, waive or circumvent mandatory laws or regulations applicable to the ownership, registration, safety, operation or occupancy of the Property in Québec, Canada, or any consumer right that cannot lawfully be waived.

If any provision of these Terms is determined to be invalid or unenforceable, that provision will be limited or interpreted to the extent necessary to comply with applicable law, and the remaining provisions will remain in effect.

15. Changes to These Terms

The Terms applicable to a reservation are those presented to the Guest when the reservation is completed.

FABELLA may modify these Terms for future reservations. Changes made after a confirmed reservation will not retroactively alter the contractual terms of that reservation except when required by law or expressly agreed to by the parties.

16. Acceptance

By completing a direct reservation through the FABELLA Mountain Stay website, the Guest acknowledges having had the opportunity to review these Terms before payment and agrees to be bound by them.
